1. Acceptance of These Terms

These Terms of Service ("Terms") govern your access to and use of the AlgoSwish mobile application, website, subscriptions, content, analytics, model outputs, rankings, tracking tools, and related services (collectively, the "Service") provided by AlgoSwish LLC ("AlgoSwish," "we," "us," or "our").

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the Service.

2. Eligibility

You must be at least 21 years old, or the age of majority or minimum age required by applicable law in your jurisdiction, whichever is higher, to use the Service.

By using the Service, you represent and warrant that:

• you meet the applicable age requirement;

• you are legally permitted to access sports betting-related informational and analytics tools where you are located; and

• you will comply with all laws, regulations, and rules that apply to you.

The Service is intended for users in the United States and Canada. You are solely responsible for ensuring that your use of the Service is lawful in your jurisdiction.

3. What AlgoSwish Is

AlgoSwish is a sports analytics, research, and informational platform designed to help users analyze sports data, model-based insights, trends, and related information.

The Service may include, for example:

• player and team statistics;

• odds-related research;

• model-ranked picks or projections;

• probabilities, confidence scores, or similar outputs;

• parlay research tools;

• tracking tools for a user’s own wagers or records;

• filters, rankings, and backtesting or historical analysis features.

4. What AlgoSwish Is Not

AlgoSwish is not a sportsbook, bookmaker, casino, gambling operator, broker, exchange, financial institution, investment adviser, fiduciary, or wagering platform.

AlgoSwish does not:

• accept or place wagers;

• hold, transfer, or manage betting funds;

• link to or control sportsbook accounts on your behalf;

• execute bets or cashouts for you; or

• guarantee the availability, legality, pricing, or success of any wager.

Any subscription fee paid through the app is solely for access to app features and content, not for placing bets or participating in gambling through AlgoSwish.

5. Informational Use Only; No Advice

All content, data, tools, outputs, picks, parlays, rankings, scores, probabilities, expected value calculations, trends, analysis, and other materials provided through the Service are for informational, educational, research, and entertainment purposes only.

AlgoSwish does not provide:

• financial advice;

• investment advice;

• gambling advice;

• legal advice;

• tax advice; or

• any other professional advice.

Nothing in the Service is a recommendation or instruction to place a wager, risk money, or make a financial decision. You should independently verify all information before acting on it.

6. No Guarantees; Use at Your Own Risk

Sports outcomes are inherently uncertain. Betting involves substantial risk, including the risk of losing all money wagered.

AlgoSwish makes no representation, warranty, or guarantee that any content or output in the Service will be:

• accurate;

• complete;

• current;

• profitable;

• suitable for your purposes;

• available at the time you view it; or

• successful in predicting outcomes.

Past performance, historical trends, backtests, hit rates, return on investment figures, expected value figures, model outputs, confidence scores, and prior records do not guarantee future performance or results.

You are solely responsible for all decisions you make based on the Service, including whether to place, avoid, size, combine, hedge, modify, or cash out any wager.

7. Independent Verification

Odds, lines, player news, injury reports, sportsbook rules, settlement rules, limits, availability, timing, and legal restrictions can change rapidly and may differ by location, account, and sportsbook.

You are solely responsible for independently verifying all relevant information before relying on it or taking any action.

8. Responsible Gambling

Do not use the Service to support irresponsible or unlawful gambling behavior.

Only gamble if it is legal where you are located and only with money you can afford to lose. Do not rely blindly on the Service, any model, any content creator, or any single source of information.

If gambling causes distress or harm, stop and seek help from appropriate responsible gambling resources in your jurisdiction.

9. Accounts

Some features may be available without an account, while others may require account creation.

If you create an account, you agree to:

• provide accurate and current information;

• keep your credentials secure;

• not share your account; and

• promptly notify us of unauthorized access or suspected misuse.

You are responsible for activity that occurs under your account.

10. . Account Deletion

You may request deletion of your account through the in-app deletion feature or through the web-based account deletion method identified on our website.

We may retain certain information where required or permitted by law, or where reasonably necessary for security, fraud prevention, billing, dispute resolution, legal compliance, or enforcement of our agreements.

11. Subscriptions, Trials, Billing, and Cancellation

AlgoSwish may offer free and paid tiers, including promotional pricing, early-bird pricing, recurring subscriptions, and free trials.

Subscription details, including price, billing frequency, and trial terms, will be presented to you before purchase. Promotional pricing may be changed or discontinued prospectively at any time.

If you purchase a subscription through the Apple App Store or Google Play, your billing relationship is with the applicable platform, and your subscription will generally auto-renew unless canceled before renewal in accordance with that platform’s rules.

Subscription management, cancellation, billing, and many refund matters are handled by Apple or Google under their applicable terms and policies. Where permitted, we may also review support requests on a case-by-case basis, but we do not guarantee refunds except where required by law or applicable platform rules.

Except as required by law, payments are non-refundable and non-creditable for partial periods.

12. User Data and Tracking Tools

If you use any recordkeeping, tracking, note-taking, or personalization features, you are solely responsible for the information you enter.

Bet tracking and performance-tracking features are provided for personal informational use only and may not reflect actual sportsbook grading, voids, settlement practices, tax consequences, account restrictions, bonuses, or promotional adjustments.

13. Acceptable Use

You may not:

• use the Service for unlawful purposes;

• scrape, extract, copy, republish, resell, sublicense, or commercially exploit Service content;

• share paid content or bypass paywalls;

• reverse engineer, decompile, probe, or attempt to derive source code, model logic, or protected systems;

• interfere with the Service’s operation or security;

• use bots, automation, or unauthorized scripts to access the Service;

• impersonate another person or misrepresent your identity; or

• use the Service in a way that infringes third-party rights.

14. Intellectual Property

The Service, including its software, content, design, trademarks, branding, rankings, models, outputs, graphics, compilations, and other materials, is owned by AlgoSwish LLC or its licensors and is protected by applicable intellectual property laws.

Subject to these Terms, we grant you a limited, revocable, non-exclusive, non-transferable license to use the Service for your personal, lawful, non-commercial use.

15. Third-Party Services and Data Sources

The Service may rely on third-party providers, including authentication providers, app stores, billing providers, hosting providers, analytics providers, and sports data or odds data providers.

We are not responsible for third-party services, third-party terms, or third-party data inaccuracies, delays, outages, or changes.

16. Service Availability and Changes

We may update, modify, suspend, restrict, or discontinue any part of the Service at any time, with or without notice.

We may also change pricing, features, limits, models, data sources, and availability at any time. We are not liable for outages, stale data, changed functionality, or discontinued features.

17. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE."

TO THE FULLEST EXTENT PERMITTED BY LAW, ALGOSWISH LLC DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AVAILABILITY, AND RESULTS.

18. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, ALGOSWISH LLC AND ITS OWNERS, OFFICERS, EMPLOYEES, CONTRACTORS, AFFILIATES, LICENSORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOST PROFITS, LOST DATA, LOST WAGERING OPPORTUNITIES, BETTING LOSSES, LOST WINNINGS, BUSINESS INTERRUPTION, OR LOSS OF GOODWILL, ARISING OUT OF OR RELATED TO THE SERVICE.

TO THE FULLEST EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF:

• USD $100; or

• the amount you paid to AlgoSwish for the Service during the three months before the event giving rise to the claim.

19. Indemnification

You agree to defend, indemnify, and hold harmless AlgoSwish LLC and its affiliates, officers, employees, contractors, licensors, and service providers from and against any claims, losses, liabilities, damages, judgments, costs, and expenses arising out of or related to:

• your use of the Service;

• your violation of these Terms;

• your violation of applicable law;

• your betting activity; or

• your infringement of any third-party right.

20. Governing Law and Venue

These Terms are governed by the laws of the State of New Jersey, without regard to conflict-of-law rules, except to the extent consumer protection law in your jurisdiction requires otherwise.

Any dispute that is not subject to arbitration, if arbitration is later added, shall be brought exclusively in the state or federal courts located in New Jersey, and you consent to that venue and jurisdiction, except where prohibited by applicable law.

21. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we may provide notice through the app, website, email, or another reasonable method. Your continued use of the Service after updated Terms become effective means you accept the revised Terms.
